Our Approach to Property Law

When acting for the Purchaser in a conveyancing matter, the following is a basic outline of what Goldsmiths Lawyers do:
Pre-Contract
  • Goldsmiths to review contract and section 32.
  • Goldsmiths will suggest any amendments and conditions to be inserted into the contract.
  • Goldsmiths will negotiate with the vendor’s lawyers (if instructed).
Post-Contract
  • After the contract is signed by all parties, Goldsmith will send out a retainer letter.
  • Client is recommended to take out home insurance.
  • If the contract is subject to finance and/or building and pest inspection or any other conditions, the client will tell Goldsmiths whether they are satisfied with the conditions before the expiry date.
  • Goldsmiths will conduct rates and planning searches.
Pre-Settlement
  • Goldsmiths will prepare the purchaser's caveat (if instructed), nomination (if any), transfer of land, a statement of adjustments and complete the purchaser’s part of the State Revenue Office duties online form.
  • Client will need to sign various documents for the purchase and provide their ID for verification purposes.
  • Goldsmiths will liaise with your lender for the upcoming settlement and invite them to electronic settlement platform called PEXA.
  • Goldsmiths will liaise with the vendor’s lawyers regarding the statement of adjustment, duties online form, CGT and GST withholding obligations.
  • If it is a cash purchase, client will need to deposit the settlement funds (including stamp duty and other fees and charges) into the Goldsmiths Lawyers Trust Account.
  • If the purchase is funded by a lender, the client will need to ensure that all loan documents are signed and the lender is ready to settle and provide settlement funds (including stamp duty and other fees and charges) on the due date.
  • Client will need to arrange for a final inspection with the agent.
Settlement
  • In most of the cases, settlement will be conducted electronically in an online platform called PEXA.
    Goldsmiths will attend settlement via PEXA.
Post-Settlement
  • Goldsmiths will advise the client and the agent once the settlement is complete.
  • Goldsmiths will notify the relevant authorities of the purchase being the Notice of Acquisition/Disposition.
  • Goldsmiths will send out the final letter.
When acting for the Vendor in a conveyancing matter, the following is a basic outline of what Goldsmiths Lawyers do:
Pre-Contract
  • Client to give initial instructions to prepare the Contract & Section 32 Statement.
  • Goldsmiths will send out a retainer letter containing a vendor’s questionnaire, which Goldsmiths request the client to complete.
  • Goldsmiths will conduct the necessary rates and planning searches.
  • Goldsmiths will prepare the Contract and Section 32.
  • Goldsmiths will provide the Contract and Section 32 to the client and the agent.
Post-Contract
  • After the contract is signed by all parties, the client instructs the agent for them to send the fully executed Contract and Section 32 to Goldsmiths.
  • Goldsmiths will liaise with the agent to confirm the amount of the deposit paid by the purchaser.
  • If instructed by the client, Goldsmiths will prepare a Section 27 Statement to endeavour an early release of the deposit.
Pre-Settlement
  • Goldsmiths will prepare the purchaser's caveat (if instructed), nomination (if any), transfer of land, a statement of adjustments and complete the purchaser’s part of the State Revenue Office duties online form.
  • Client will need to sign various documents for the purchase and provide their ID for verification purposes.
